ITN Cleaning Terms and Conditions

The terms and conditions of ITN Cleaning apply only for the services which are offered by ITN Cleaning and not for all services offered at *.domestina.co.uk.

For all cases which are not explicitly specified by ITN Cleaning's terms and conditions, the terms and conditions of Domestina apply(listed below).

ITN Cleaning uses the Domestina platform for its online presence.

These GENERAL TERMS AND CONDITIONS govern the relationship between ITN CLEANING LTD., hereinafter referred to as "ITN CLEANING", and the Users of Internet Sites and Services located on the domain www.itncleaning.co.uk and itncleaning.domestina.co.uk (hereinafter referred to as “the Users”).

Please read the following Terms and Conditions before using the information and services offered by www.itncleaning.co.uk (referred to as “The Services”). By visualizing and using the services on www.itncleaning.co.uk, each User automatically complies and agrees with the terms and conditions described below.

The confirmation of the General Terms and Conditions is a necessary and indispensable condition for the conclusion of the contract between the User and “ITN CLEANING".

CLAIMS AND COMPLAINS

Art. 1 (1) The User is entitled to a claim for any non-conformity of the service with the agreed / ordered. (2) "ITN CLEANING" only owes access to its platform. All complaints about the activities of Cleaners/Housemaids go directly to them.
(3) "ITN CLEANING" is not responsible for damages and material damages incurred as a result of the activity of Cleaners/Housemaids.
(4) All Cleaners/Housemaids, as self-employed, must have their own Public Liability Insurance in place as required by law. “ITN CLEANING” shall not be obliged to check if such Insurance policies are present and made by Cleaners/Housemaids registered on the ITN CLEANING website.
(5) In the unlikely event of any damage, ITN CLEANING’s Public Liability Insurance will cover any claims over £300 only where the Cleaner/Housemaid’s Public Liability Insurance is not applicable, not present or invalid. For any claims below £300 or the first £300 of any larger claim the Cleaners/Housemaids take sole and full responsibility.

Art. 2 (1) The User has the right of claim and complaint from the service regardless of if the trader has provided a commercial guarantee of the good or service.
(2) Service complaints may be claimed up to 14 days after the discovery of the nonconformity of the service with the agreed service provision.

Art. 3. (1) The complaint shall be filed in the telephone number specified by "ITN CLEANING" or in writing, by e-mail or by post sent to the registered address of the company. "ITN CLEANING" provides access to a claim form on its website.
(2) In case of a claim, the User shall indicate the subject of the claim, the preferred way of satisfaction ofthe claim, respectively the amount of the claim, address, telephone number and contact email.
(3) When submitting a claim, the User shall also attach the documents on which the claim is based, namely:

Art. 4. Making a complaint is not an obstacle to make a claim.

Art. 5. (1) "ITN CLEANING" maintains a register of the submitted claims. A document is sent to the User at the specified email, indicating the number of the claim from the register and the type of the goods. (2) Where "ITN CLEANING" satisfies the claim, it shall issue an act for this, which shall be drawn up in duplicate and shall provide one copy to the User.

Domestina Terms and Conditions

These GENERAL TERMS AND CONDITIONS govern the relationship between Domestina, hereinafter referred to as "Domestina", and the Users of Internet Sites and Services located on the domains *.domestina.co.uk (hereinafter referred to as “the Users”).

Domestina is a platform for booking/managing/paying cleaning services. It is not a provider of cleaning services.

The Domestina terms and conditions apply, unless overridden by the terms and conditions of a partner company which offers services on the platform.

This document contains information about the activity of Domestina and the general terms and conditions of use of the services provided by Domestina, by settling the relations between us and each of our users.

The confirmation of the General Terms and Conditions is a necessary and indispensable condition for the conclusion of the contract between the User and Domestina.

PROVIDED SERVICES

Art. 1 The services provided by Domestina to the Users are online services in the means of the Electronic Commerce Regulations 2002.

Art. 2. (1) Domestina is a platform through which the User can hire a professional cleaner or Housemaid for one-off cleans or regular cleaning of households and / or offices. (2) The cleaning service providers are separate companies/self employed people and not Employees of Domestina.

IDENTIFICATION AND REGISTRATION. PERSONAL DATA

Art. 3 (1) Domestina identifies Users of the website by an ID stored in a cookie in the user's browser.
(2) Domestina has the right to collect and use information about the Users after their registration. The information by which the person can be identified may include name, surname, address, phone number, and any other information that the person provides voluntarily upon registration. The information also includes any other information that the User enters, uses or provides upon use of the Services offered by Domestina.
(3) Site identification is possible via Facebook and Google Account.

Art. 4 (1) Domestina shall exercise due diligence and shall be responsible for the protection of the User's information, which has become known to it regarding the registration, subject to these General Terms and Conditions, except in the case of force majeure, accidental event or malicious actions of third parties.
(2) In the registration form, filled in by the User upon registration, Domestina denotes the mandatory or voluntary nature of the provision of the data and the consequences of refusal to provide it. By agreeing to these General Terms and Conditions, the User agrees that the information will be processed in the order specified therein.
(3) The restrictions under para. 1 shall not apply in the event that Domestina has an obligation to provide the User's personal information to the relevant competent state authorities under the current legislation (eg. Police, Court).

Art. 5 (1) Domestina shall collect and use the information under Art. 4 for the purposes set forth in these General Terms and Conditions, as well as for offering new Consumer goods and / or services (free of charge or paid). The described purposes for which the information is used are not exhaustively listed and do not create Domestina obligations.
(2) By accepting these General Terms and Conditions, the User agrees with the processing of his / her personal data for the purposes of this Agreement and the Direct Marketing.

Art. 6 (1) The User may register by filling in the relevant online registration form available online on the Domestina website, agreeing to the present General Terms and Conditions and declaring that it is competent.
(2) By clicking on the virtual button "Register" with the force of a written confirmation of the General Terms and Conditions, the User makes an electronic statement within the meaning of the Electronic Communications Act 2000, stating that he/she is familiar with these General Terms and Conditions, accepts and undertakes to observe them. By registering it on a relevant drive in the Domestina server, through a commonly accepted standard for transformation in a technical way that makes possible its reproduction, the electronic statement acquires the quality of an electronic document within the meaning of the cited law. Domestina may store in the log files on its server the IP address of the User as well as any other information necessary to identify and reproduce its electronic statement for acceptance of the General Terms and Conditions in the event of a legal dispute. The text of these Terms and Conditions is available on the Domestina website in a way that allows it to be stored and reproduced.
(3) When completing the application for registration, the User is obliged to provide complete and correct data on the identity (for individuals), the legal status (for Companies) and other data required by the electronic form of the Domestina, as well as to update them within 7 (seven) days of their change. The User declares that he agrees to provide the required personal data, ensuring that the data he provides during the registration process is true, complete and accurate, and will update them in a timely manner if any changes of the data occur. In the event of false data being provided, Domestina has the right to terminate or suspend without delay the provision of the services as well as the maintenance of the User's account.

Art. 7 (1) Upon registration, the User shall receive a unique username and password to access the services available through the Domestina website.
(2) The username with which the User registers does not give him any rights other than the right to use the specific username in the Domestina online platform.
(3) The registrant in his / her capacity as a representative of a Company shall be obliged to enter his / her full name and address, respectively the name of the Company he/she represents. By accepting the Terms and Conditions, the registrant guarantees and confirms that he/she has a contractual relationship with the registered user Company. In the event of incorrect or misleading information, the party is deprived of the right of access to the services on the Domestina website.
(4) The user is obliged to take all care and to take the necessary measures, which are reasonably imposed, in order to protect his / her password, and not to disclose to third parties his / her password and to immediately notify Domestina in case of unauthorized access, as well as probability and suspicion of such access. He / she bears the responsibility and risk of protecting his / her password, as well as all actions performed by him / her or by a third person using his / her password.

Art. 8 (1) The user has the right to access on-line the services provided through the Domestina website, following the conditions and access requirements set by Domestina. In order to be able to use the services, the User should enter his username and password.
(2) The user has the right of access and online correction of the personal data provided at the registration.

MAKING AN ORDER

Art. 9 (1) Users shall use the interface of the Domestina website to conclude service contracts for the services offered by Domestina in the e-shop.
(2) The service contract shall be deemed to have been concluded from the moment the order is confirmed by Domestina or any of its partners.

Art. 10 (1) The user selects one or more of the services offered on the site.
(2) It is necessary for the User to choose the method and time of payment of the price and then to confirm the order via the e-shop interface.
(3) When making an order, the User receives an email confirmation that his order has been accepted.

PRICES

Art. 11 (1) The prices of the services offered in the online store are those listed on the Domestina website at the time of placing the order, except in the case of obvious error.
(2) The User receives two separate invoices for each payment - one from the Cleaner/Housemaid for the provided cleaning service and one from the partner company for making the services available on the Domestina platform.
(3) The prices of the products include VAT, where applicable.

Art. 12 Domestina reserves the right to change at any time and without notice the prices of the services offered in the online store, and such changes will not affect any orders already made.

Art. 13 (1) Domestina may grant discounts for the services offered in the online store in accordance with the English legislation and rules defined by Domestina. The rules applicable to such discounts are available at the place where the discount is shown. Discounts can be provided in a variety of forms (eg promotions, loyalty rewards, provided individually, randomly or as a result of participation in a competition or customer survey).
(2) Different types of discounts cannot be combined when ordering and purchasing the same type of service.

PAYMENT

Art. 14 (1) The User may pay the price of the ordered services using one of the options listed on the website of his / her choice. At *.domestina.co.uk for all direct booking options payment is possible by credit or debit card only. (2) The system shall block the amount for an upcoming visit six days before and withdraw the blocked amount one hour after the end of the visit.

Art. 15 If the User opts for a payment method involving a third party payment service provider, the User may be bound by the terms and conditions and / or fees of such third party.

Art. 16 Domestina is not responsible if a payment method involving a third party payment service provider is unavailable or otherwise not functioning for reasons that cannot be attributed to the fault of Domestina.

REFUSAL OF CONTRACT AND REPLACEMENT

Art. 17 (1) The User has the right to withdraw from the contract without giving any reason, without due compensation or penalty, within 14 calendar days from the date of conclusion of the service contract.
(2) The user has the right to change paid visits up to 48 hours before 00:00 on the date of service provision. The following rules and fees will then apply:

  1. Fee will be charged from the amount paid for the changed visit in case the visit is changed less than 48 hours before 00:00 on the date of service provision and before 19:00 (7pm) on the day before the visit. The size of the fee is specified in the terms and conditions of the serving company.
  2. Cancellation of a visit after 19:00 on the day before the visit is not possible. In the event that the User is unable to provide access to the Cleaner/Housemaid and is unable to accept the arranged visit, the User will be charged the full cost of the service.
(3) Should a FIX subscription visit be omitted:
  1. Users have the right to cancel for free one visit for every 4 passed visits for the subscription. Free cancels can be accumulated to cancel visits up to three weeks in the future.
  2. If the User has reached the limit of free cancellations or has less than 48 hours until 00:00 on the day of the visit, a fee is imposed. The size of the fee is specified in the terms and conditions of the serving company.
  3. A visit cannot be cancelled after 19:00 on the day before the visit.
(4) In order to exercise its right under this clause, the User uses his / her profile on the website.
(5) Domestina publishes on its website a form for exercise of the right of withdrawal from the contract.
(6) In order to exercise the right of withdrawal, ITN CLEANING provides the User with the option to fill in and electronically send through the website the standard withdrawal form or other unambiguous application. In these cases, Domestina immediately sends the user confirmation of receipt of the refusal.

Art. 18 The consumer has no right to withdraw from the contract in the event that the subject matter is the provision of services where the service has been provided in full and its execution has begun with the explicit prior consent of the User and confirmation by the User that he knows he will lose the right of withdrawal, once the contract has been fully executed by the trader.

TERMINATION

Art. 24 Domestina has the right, in its sole discretion, without giving notice, to unilaterally terminate the contract if it finds that the services provided are used in violation of the present general conditions, the legislation of England and the generally accepted moral norms.

INTELLECTUAL PROPERTY

Art. 25 (1) The intellectual property rights of all materials and resources located on the Domestina website (including the available databases) are protected under the Copyright, Design and Patent Act 1988, belong to “DOMESTINA” or the corresponding person who was delegated the right to use DOMESTINA and cannot be used in violation of applicable law.
(2) In the case of copying or reproduction of information outside the admissible, as well as any other violation of the intellectual property rights on the resources of DOMESTINA, DOMESTINA have the right to claim for the direct and indirect damages in full.
(3) Except as expressly agreed, the User may not reproduce, modify, delete, publish, distribute and otherwise disclose the information resources posted on the Domestina website.

Art. 26 (1) Domestina undertakes to exercise the due care to ensure that the User has the right to access the provided services.
(2) Domestina reserves the right to discontinue access to the provided services. Domestina has the right but not an obligation, in its sole discretion, to delete information resources and materials published on its website.

TERMINATION AND DEPARTURE OF THE CONTRACT

Art. 27 (1) Except as provided in these General Terms, the Contract between the Parties shall also be terminated upon termination of the activity of Domestina or termination of maintenance of its website.

Art. 28 Except as outlined above, either party may terminate this Agreement by giving one week's notice to the other party in case of non-performance of the obligations under the contract.

Art. 29 The written form of the contract is deemed to be respected by sending an e-mail message, pressing an electronic button on a content page to be filled in or selected by the User or a check box on the website, etc. similar, insofar as the statement is recorded technically in a way that enables it to be reproduced.

SETTLEMENT OF DISPUTES

Art. 31 (1) Users can use the European Dispute Resolution Online Platform (ODR) available at / http://ec.europa.eu/odr/ - a single access portal allowing EU consumers and traders to settle the disputes that have arisen between them.
(2) Alternative dispute resolution (ADR) between consumers and traders is an out-of-court conciliation procedure on a voluntary basis.
(3) The general conciliation commissions help to reach agreement between consumers and traders in disputes concerning contracts for the sale of goods and the provision of services.

SAFEGUARD CLAUSE

Art. 32 The parties declare that if any of the provisions of these Terms and Conditions prove to be invalid, this will not result in the invalidity of the entire contract or any of its parts. The invalid clause will be replaced by the mandatory rules of the law or established practice.

AMENDMENT TO THE GENERAL CONDITIONS

Art. 33 (1) Domestina undertakes to notify Users of any amendment to these General Terms and Conditions within 7 days of the occurrence of this circumstance at the specified by the User email address. (2) When disagreeing with the amendments to the General Terms and Conditions, the User has the right to withdraw from the contract without giving any reason and without indemnity or penalty. In order to exercise this right, the Consumer should notify Domestina within one month of receiving the notice under the preceding paragraph. (3) In the event that the User does not exercise his right to withdraw from the contract under the terms and conditions set forth in these General Terms and Conditions, the amendment is deemed to have been accepted by the User without objection.

APPLICABLE LAW

Art. 34 For all matters not covered by these General Terms and Conditions, the provisions of the current legislation of England shall apply.
